Terms of use

1. Service and operator

Embaixadinha is provided by Guse LTDA, CNPJ 47.758.713/0001-82, Brazil. These terms cover the app, embaixadinha.com and services at api.embaixadinha.com. By using the service, you agree to these terms, without giving up mandatory consumer rights. Contact: embaixadinhaapp@gmail.com.

2. Use and permissions

You receive a personal, limited, non-exclusive licence to use the app under these terms and App Store rules. App Store apps are also subject to Apple’s Standard EULA unless a custom licence is provided in the store. You must have legal capacity to enter an agreement; minors must have guardian permission and supervision where required. Features may require a compatible device, permissions, connectivity and Apple accounts.

3. Estimates and training safety

Touch counts and height, speed and pose estimates depend on video quality, lighting and framing. Results may contain errors or be unavailable when evidence is insufficient. They support training and are not official measurements, medical advice or a performance guarantee.

Choose a safe place to play, protect your device and respect your physical limits. Do not use the app in a way that puts you or others at risk.

4. Your videos and content

You retain rights to your videos. You are responsible for required permissions from people filmed and for respecting image and intellectual property rights. Local analysis does not grant us a licence to use your video in advertising.

You choose an export destination. Sharing on another platform subjects content to that platform’s rules. Do not publish unlawful, abusive, discriminatory or privacy-infringing content, or improperly expose children.

5. Accounts, groups and leaderboards

Protect your credentials and provide accurate information. Shared nicknames and scores can be seen by other players according to the feature. Share group invitations only with intended participants; anyone with a valid invitation may request access according to the group rules.

Do not manipulate videos, results or scores to gain an advantage, bypass restrictions, abuse invitations, interfere with the service or access others’ accounts. Imported videos are not eligible for leaderboards. We may remove results or restrict access for fraud, abuse or violations, subject to applicable rights. Game Center also follows Apple’s rules.

6. Purchases and subscriptions

The app and App Store display price, currency, benefits, duration and any trial before purchase. Subscriptions may renew automatically under the terms displayed by Apple unless cancelled before renewal. Manage and cancel through your Apple ID subscriptions; deleting the app or account does not cancel a subscription.

Apple processes billing. Request refunds through Apple’s channels; contact us if you need help. Statutory withdrawal, refund and warranty rights remain available. In Brazil, this includes the withdrawal right under the Consumer Protection Code where applicable.

7. Privacy and cookies

The Privacy policy describes local data, online services, Apple, Cloudflare, Sentry, PostHog and RevenueCat. The Cookie policy describes Google Analytics, Google Tag Manager, TikTok Pixel and Meta Pixel on the website. Optional advertising and analytics depend on your cookie choices; accepting these terms does not authorise that tracking.

8. Intellectual property and permitted use

Embaixadinha’s code, brand, visual elements and other materials belong to Guse LTDA or its licensors. You may not redistribute the app, remove rights notices, exploit vulnerabilities or copy materials for commercial use without permission, except as allowed by law.

9. Availability and ending use

We may fix, update or modify features and temporarily interrupt service for maintenance or security. Material changes affecting paid services will be communicated as required by law. We do not guarantee uninterrupted access or preservation of results if you lose your device; keep copies of videos you want to retain.

You may stop using the service and request account deletion. Legally retained data and previously shared copies are covered by the Privacy policy. Abuse restrictions do not remove mandatory consumer rights.

10. Liability and consumer rights

The service is subject to warranties and responsibilities required by law. To the extent legally permitted, we are not responsible for failures caused by misuse, devices or third-party services outside our control. Nothing excludes liability or rights that cannot legally be limited.

11. Applicable law and disputes

Brazilian law applies without displacing mandatory protections in your jurisdiction of residence. Contact embaixadinhaapp@gmail.com to try to resolve questions or disputes. You retain the right to approach authorities and the competent courts, including consumer courts where provided by law.

12. Changes and contact
